MEDIATION Court approved in compliance with MCR 3.216. Mr. Morgan conducts both facilitative and evaluative mediation regarding all family law issues including child custody, support and parenting time; and, all property issues.
FACILITATIVE MEDIATION (MCR 3.216) The mediator's primary role is to assist the parties in reaching agreement through discussions in a positive and productive manner. The parties are expected to be active in the process, discussing their position and giving consideration to the other side's position as they construct a settlement agreement. Creative and tactical thinking by all participants often help resolve the case. Normally the mediator does not offer resolutions, but assists the parties in reaching their own agreement. Parties are not required to be represented by counsel, although it is usually recommended.
EVALUATIVE MEDIATION The mediator's primary role is to assist the parties in reaching agreement through discussions of their respective positions, and examining the various issues they present themselves, or through counsel if represented. The mediator may offer suggestions for resolution, and may make recommendations.
